The Difference Between False Reporting and Defamation Under UAE Law.

In today’s fast-paced world and the age of social media, some individuals may rush to file complaints or make public accusations without understanding the legal consequences. This article explains the difference between the crime of false reporting and the crime of defamation under UAE law, as well as the penalties associated with each.

1- What Is False Reporting?
False reporting involves informing the authorities about a crime that did not actually occur, while the reporter knows the information is untrue, with the intention of harming another person.
o Example: A person files a report accusing their neighbor of theft, knowing the accusation is false.

2- What Is Defamation?
Defamation is attributing a false fact that harms someone’s reputation or honor, whether verbally, in writing, or through social media.
o Example: Publishing a Facebook post accusing someone of corruption without evidence.

3- Key Difference:
o False reporting is made directly to an official authority (e.g., police or prosecution).
o Defamation can occur publicly or through media and online platforms.

4- Legal Penalties:
o False Reporting:
Punishable by imprisonment, a fine, or both, according to Article 324 of the UAE Penal Code.
o Defamation:
Punishable by imprisonment and a fine. The penalty is more severe if the defamation occurs online, under the UAE Cybercrime Law.

5- Can Both Crimes Occur Together?
Yes, if someone files a false report with the authorities and also spreads the same accusation on social media, they may be charged with both crimes simultaneously.

Conclusion:
Filing complaints or making accusations should never be used as tools for revenge or public shaming. UAE law strongly protects individual reputation and punishes anyone who deliberately harms others without evidence. It is always best to consult legal experts before taking any action that might result in criminal liability.
